Cheating during examinations is triggered by peer influence. It makes every learner know and do what should not be done. Cheating during examinations defeats the purpose of understanding, applying and creating ideas as stipulated in the revised Bloom's taxonomy by Anderson. The study reported here was designed to delve into the reasons and aspirations of the respondents in their cheating engagement. Sixteen (16) key informants, selected using random sampling procedure among Junior and Senior High School learners of Roxas National Comprehensive (...) High School in Palawan during the months of June to October 2016, completed open-ended questionnaires and took part in the interview. NVivo software was used in the analysis of the themes that emerged from the data. This study discovered that friendship is manipulated, for it makes doing right things unacceptable and things to be avoided like cheating seem right and acceptable. The behavior about cheating during examination is deeply rooted in the culture of pakikisama (social acceptance/liking) and utang ng loob (debt of gratitude). If a learner does not share his or her answers, he or she will be labeled as walang pakisama (no concern).This paper then argues that honesty should not be just a policy; rather, honesty in this case, is the only policy. Condemning academic dishonesty must not merely rest in the enrollment forms, but by constant moral reminder and intervention of teachers who have a responsibility to hone learners' decorum on honesty and maturity. In In V Metaphysics, lec. 9, Aquinas distinguishes between “being by accident” (ens per accidens) and “being by itself” (ens per se) and includes the nine accidental categories under the latter. But isn’t substance a being per se while accidents are, by definition, accidental beings? Several authors—including Ralph McInerny, Paul Symington, and Greg Doolan—have offered explanations of this strange classification. Drawing on an overlooked parallel text in the Posterior Analytics commentary and on Aquinas’s critique of Avicenna’s understanding of accidental denominatives, (...) this paper presents an alternative explanation of the lecture. In this paper, I explore what gives collective testimony its epistemic credentials, through a critical discussion of three competing accounts of the epistemology of collective testimony. According to the first view, collective testimony inherits its epistemic credentials from the beliefs the testimony expresses— where this can be seen either as the beliefs of all or some of the group’s members, or as the beliefs of group itself. The second view denies any necessary connection to belief, claiming instead that the epistemic (...) credentials of collective testimony derive from the reliability or truth-conduciveness of the statement that expresses the testimony. Finally, the third view claims that the epistemic credentials of collective testimony derive from the fact that it involves undertaking a collective commitment to trustworthiness, which makes the group susceptible to rebuke and blame if its testimony is not trustworthy. I argue that this last account holds the most promise for preserving what is distinctive about testimonial knowledge while still underwriting a robust epistemology of collective testimony. (shrink)

Over the past few decades, Indigenous communities have successfully campaigned for greater inclusion in decision-making processes that directly affect their lands and livelihoods. As a result, two important participatory rights for Indigenous peoples have now been widely recognized: the right to consultation and the right to free, prior and informed consent (FPIC). Although these participatory rights are meant to empower the speech of these communities—to give them a proper say in the decisions that most affect them—we argue that the way (...) these rights have been implemented and interpreted sometimes has the opposite effect, of denying them a say or ‘silencing’ them. In support of this conclusion we draw on feminist speech act theory to identify practices of locutionary, illocutionary, and perlocutionary group silencing that arise in the context of consultation with Indigenous communities. Jennifer Lackey (2018) has developed an account of the primary form of group assertion, according to which groups assert when a suitably authorized spokesperson speaks for the group. In this paper I pose a challenge for Lackey's account, arguing that her account obscures the phenomenon of group silencing. This is because, in contrast to alternative approaches that view assertions (and speech acts generally) as social acts, Lackey's account implies that speakers can successfully assert regardless of how their utterances are taken (...) up by their audiences. What reflection on group silencing shows us, I argue, is that an adequate account of group assertion needs to find a place for audience uptake. (shrink)

According Philip Pettit, suitably organised groups not only possess ‘minds of their own’ but can also ‘make up their minds’ and 'speak for themselves'--where these two capacities enable them to perform as conversable subjects or 'persons'. In this paper I critically examine Pettit's case for group personhood. My first step is to reconstruct his account, explaining first how he understands the two capacities he considers central to personhood – the capacity to ‘make up one’s mind’, and the capacity to ‘speak (...) for oneself’ – before showing how he thinks these can be manifested in groups. With Pettit’s account duly reconstructed, I then turn to criticism, arguing that Pettit’s construal of making up one’s mind does not do proper justice to our first-personal self-understanding, nor to our characteristic interpersonal forms of engagement. This leads me, finally, to consider an alternative construal of ‘making up one’s mind’ and ‘speaking for oneself’ that is associated with the work of Richard Moran and whichargue, could usefully be exteextended to groups. Recent feminist philosophy of language has highlighted the ways that the speech of women can be unjustly impeded, because of the way their gender affects the uptake their speech receives. In this chapter, I explore how similar processes can undermine the speech of a different sort of speaker: Indigenous communities. This involves focusing on Indigeneity rather than gender as the salient social identity, and looking at the ways that group speech, rather than only individual speech, can be unjustly impeded. To (...) do this, I make use of the notion of ‘discursive injustice’ that has been developed by Quill Kukla, and, with reference to three case studies, show how discursive injustice can effectively derail the speech of Indigenous communities. Politics, Philosophy & Economics, Volume 21, Issue 4, Page 347-371, November 2022. We sometimes have to choose between options that are seemingly incomparable insofar as they seem to be neither better than, worse than, nor equal to each other. This often happens when the available options are quite different from one another. For instance, consider a choice between prioritizing either criminal justice reform or healthcare reform as a public policy goal. Even after the relevant details of the goals and possible (...) reforms are filled in, it is plausible that neither goal is better than, worse than, nor equal to the other. Such seemingly incomparable options present a problem for rational choice since it is unclear how an agent might rationally choose between them. What we need are some principles to help govern rational choice when faced with seemingly incomparable options. I here present three such principles. While each principle is individually compelling, I show that they are jointly incompatible. I then argue that the correct response to this inconsistent triad is to reject the principle that rationally censures performing a sequence of choices one knows will result in a suboptimal outcome. The upshot is that when seeming incomparability is involved, an agent can money pump themselves without being less rational for it. (shrink)

O autor analisa os postulados do finalismo e retira suas consequências para a delimitação do conceito de dolo. Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

I explore the possibility and rationality of interpersonal mechanisms of doxastic self-control, that is, ways in which individuals can make use of other people in order to get themselves to stick to their beliefs. I look, in particular, at two ways in which people can make interpersonal epistemic commitments, and thereby willingly undertake accountability to others, in order to get themselves to maintain their beliefs in the face of anticipated “epistemic temptations”. The first way is through the avowal of belief, (...) and the second is through the establishment of collective belief. I argue that both of these forms of interpersonal epistemic commitment can function as effective tools for doxastic self-control, and, moreover, that the control they facilitate should not be dismissed as irrational from an epistemic perspective. In this paper I critically discuss Miranda Fricker’s ‘trust-based’ view of collective testimony—that is, testimony that comes from a group speaker. At the heart of Fricker’s account is the idea that testimony involves an ‘interpersonal deal of trust’, to which the speaker contributes a commitment to ‘second-personal epistemic trustworthiness’. Appropriating Margaret Gilbert’s concept of joint commitment, Fricker suggests that groups too can make such commitments, and hence that they, like individuals, can ‘enter into the second-personal relations of trust that characterise (...) testimony’ (Fricker 2012: 272). I argue that this choice to appropriate Gilbert’s concept of joint commitment betrays a deep problem in Fricker’s account—a misconstrual of both the object and the subject(s) of the commitment a speaker makes in testifying. After developing this criticism, I outline an alternative way of construing the speaker’s commitment, which can be applied to both collective and individual testimony. (shrink)

For much of the first fifty years of its existence, analytic philosophy shunned discussions of normativity and ethics. Ethical statements were considered as pseudo-propositions, or as expressions of pro- or con-attitudes of minor theoretical significance. Nowadays, in contrast, prominent analytic philosophers pay close attention to normative problems. Here we focus our attention on the work of Searle, at the same time drawing out an important connection between Searle’s work and that of two other seminal figures in this development: H.L.A. Hart (...) and John Rawls. We show that all three thinkers tend to assume that there is but one type of normativity within the realm of social institutions – roughly, the sort of normativity that is involved in following the results of chess – and that they thereby neglect features that are of crucial significance for an adequate understanding of social reality. The theme this year is "Towards an Open Ontology Repository". This communiqué represents the joint position of those who were engaged in the year's summit discourse on an Open Ontology Repository (OOR) and of those who endorse below. In this discussion, we have agreed that an "ontology repository is a facility where (...) ontologies and related information artifacts can be stored, retrieved and managed." -/- We believe in the promise of semantic technologies based on logic, databases and the Semantic Web, a Web of exposed data and of interpretations of that data (i.e., of semantics), using common standards. Such technologies enable distinguishable, computable, reusable, and sharable meaning of Web and other artifacts, including data, documents, and services. We also believe that making that vision a reality requires additional supporting resources and these resources should be open, extensible, and provide common services over the ontologies. (shrink)

Resumo A transferência de embriões em bovinos tem o objetivo principal de aprimorar o melhoramento genético e otimizar a reprodução bovina A importância dessa prática é destacada pela sua contribuição para a maximização de características desejadas nos rebanhos, como qualidade de carne, eficiência reprodutiva e resistência a condições ambientais adversas. Este trabalho descreve e analisa as técnicas avançadas utilizadas nesse processo, incluindo seleção genômica, sexagem de embriões, produção in vitro, protocolos não cirúrgicos, sincronização reprodutiva, criopreservação de embriões e uso de (...) marcadores de fertilidade. A compreensão aprofundada dessas técnicas é fundamental para o sucesso da transferência de embriões, bem como para a capacidade de personalizar e aprimorar as características específicas dos rebanhos. Enfatizando a importância da expertise de profissionais especializados em reprodução bovina, este trabalho busca oferecer uma visão abrangente das práticas atuais e avanços tecnológicos nesse campo. Ao unir ciência e prática, torna-se importante a comparação de técnicas, bem como relacionar resultados eficientes para promover qualidade genética, trazer a sustentabilidade e envolver a técnica em um cenário atualizado da indústria. Palavras-chave: Embriões; Hormônio; Reprodutor. -/- Abstract Embryo transfer into cattle has the main objective of improving genetic improvement and optimizing bovine reproduction. The importance of this practice is highlighted by its contribution to maximizing desired characteristics in herds, such as meat quality, reproductive efficiency and resistance to environmental conditions adverse. This work describes and analyzes the advanced techniques used in this process, including genomic selection, embryo sexing, in vitro production, non-surgical protocols, reproductive synchronization, embryo cryopreservation and the use of fertility markers. An in-depth understanding of these techniques is critical to the success of embryo transfer, as well as the ability to customize and enhance specific herd characteristics. Emphasizing the importance of the expertise of professionals specialized in bovine reproduction, this work seeks to offer a comprehensive view of current practices and technological advances in this field. When combining science and practice, it becomes important to compare techniques, as well as relate efficient results to promote genetic quality, bring sustainability and involve the technique in an updated industry scenario. The paper seeks to show that the period between the years 756 and 1031, a period officially recognized as the domination of the Umayyad dynasty in the Iberian Peninsula, saw the emergence of the most important movement for the recovery of classical Greek works known, and offered the foundations for the second Renaissance, the Italian. It also shows that translation is a process that can fundamentally alter original works, as they depend on the translator's interpretation, as well as the existence (...) of equivalent words and concepts in the language to be translated. Both problems were identified in the recovery of classical Greek works by the Toledo School of Translators. The result was that Italian Renaissance was, in fact based on what had been made available by the Toledo School of Translators, which confirms the thesis that the first Renaissance was the Islamic one and that the Italian Renaissance was a later movement. According to Margaret Gilbert, two or more people collectively believe that p if and only if they are jointly committed to believe that p as a body. But the way she construes joint commitment in her account – as a commitment of and by the several parties to “doing something as a body” – encourages the thought that the phenomenon accounted for is not that of genuine belief. I explain why this concern arises and explore a different way of construing (...) joint commitment, in order to avoid the concern. This leads me to propose a revised Gilbertian account of collective belief, according to which two or more people collectively believe that p if and only if they are jointly committed to p as true. The objective of this article is to offer an interpretation of the utopian society described in Plato's Republic from a simplified theory of fractals. Plato conceptualizes his Republic as a static society in terms of structure and its components, the people, as having a behavior that can be programmed as linear and not dynamic (LNDS). Based on this analogy, real social functioning (NLDS) is conceptualized, applying the concept of fractal and its corresponding fracton, as the force of attraction that acts (...) in social groups. Thus, social groups obey a fractal geometry, a geometry that reproduces the pyramidal shape, the apex being the crystallization of authority, power or leadership. Modern society, in analogy with Plato's Republic, is also a fractal production machine, replicating pyramid-shaped hierarchical structures and the respective fractons. Individuals are the basic unit of all these fractals. They are the building blocks of all groups at all levels of society. But replication is not self-similar due to fluctuations in cognition and behavior. (shrink)

The acculturation gap is the changing set of values and culture between a child and parent or guardian. The gap is usually revealed after a family immigrates from one country to another and assimilates into a culture.

This article aims to show the emergence of Pre-Socratic Natural Philosophy using the cosmological Big-Bang analogy, where from a certain moment in time and space a universe appears, first in its "inflationary" moment and, soon, in constant expansion. In the case of natural philosophy, it arose with Thales at a certain moment in space and time. It also had its “inflationary” period marked by a large number of philoso-phers and a profound change in the understanding of nature. This period lasted (...) for about 5 generations until philosophy entered its paradigmatic period with Plato and Aristotle. How was the Natural Philosophy Big Bang (NPBB) possible? What were the main factors that made this possible? The text discusses these aspects, and for the author, the main factor must be sought in the internal dynamics of Greek thought and not in external causes, such as the exchange with Babylonians and Egyptians or the economic dynamics. -/- To explain the NPBB, I use the hypothesis of linguistic relativism, meaning that “lan-guage shapes the mind”, in the same line that Bruno Snell used in his 1956 book. That is, the development of the Greek language would be the preponderant factor to explain the dynamics that led to the NPBB. We believe that this hypothesis (currently criti-cized for being excessively deterministic) is justified when applied to the aforemen-tioned situation and can be summarized as follows: “An extraordinary situation re-quires an equally extraordinary explanation”. A set of historical occurrences justifies the application of the strong version of the concept of linguistic relativism, something that today would be difficult to occur. -/- The text synthesizes the main milestones of linguistic relativism, goes through the description of the turn of the oralist society to a society based on writing, which rad-ically changes the way knowledge is stored, in addition to enabling its critical evalua-tion, one of the foundations of philosophy and science. Several authors who are al-ready classics follow a similar line without, however, clearly adopting the author's position. These are the cases of Burnet, Havelock, and Ong. The text also shows some details of the linguistic evolution of Greek and its origins in the oralist mythical tradi-tion. -/- The main conclusion is that linguistic relativism in its strong version is an adequate method to deal with NPBB situation. -/- . The text's objective is to show that the Western scientific tradition, since the pre-Socratics, has as one of its traits the search for a unitary and uni-versal system of knowledge. Since the modern age, many attempts have been directed toward the search for the unification of science, culminating in Neurath's analytical philosophy and efforts in cybernetics. These efforts reflected an epistemological expectation for the unity of science, seeking methods and languages that would allow such an achievement. But such an expectation (...) has not yet satisfied the hopes of the monists. The diversifi-cation of science deepened and, at the same time, the problems faced by humanity increased the need for science to offer answers to solve the great global problems. The planet and humanity are under severe pressure in many ways. Pollution and depletion of water resources, threats of mass extinction of biodiversity, deforestation, desertification, global climate change, persistent poverty for large contingents of the world's population, attacks on democratic systems and values in many countries, and, at this moment, a pandemic of great proportions. In short, a threat to the sus-tainability of the planet and civilization as such. The paper goes through Mode 1 of knowledge production, showing that this Model is limited and insufficient to solve the problems humanity is facing. Model 2 of knowledge production is suggested as the immediate perspective to support the cope with humanity´s global problems. This Agenda presupposes a new way to unify science, which transdisciplinarity can bring. Therefore, the unity of science wouldn´t be through reduction-ism or the unification of language, but through the new modus operandi of transdisciplinary practice. (shrink)

This article aims to discuss on Rousseau's justification for his Metaphysical position. We note in Rousseau a justification of personal nature in response to the arguments of materialist and atheist philosophers. Rousseau also criticizes the "systems spirit". In this context that Rousseau back to read Descartes to develop a doctrine of his own. This expedient opens the perspective of a moral and personal dimension in research for truth.

The article presents two antagonistic views of reality, one coming from modern science and the other from flat-Earthers, to discuss the relationships between common-sense, science, and reality. The concrete fact under analysis refers to the solar system and the position of the earth in this system, that is, the duality of geocentrism and heliocentrism. After discussing the reasons for denying geocentrism with arguments from theoretical physics, we return to discussing the duality against the backdrop of the history of science, showing (...) that the issue was much more complex when the Ptolemaic paradigm passed to the Copernican one in the 16th century. The article shows that the paradigm shift presupposed the invention of a reality that took more than 100 years to stop being an invention and become a reality. From an epistemological point of view, a discovery, even if it corresponds to empirical facts, needs theoretical support to be considered true or, in the terms we are dealing with here, to be considered reality and part of common sense. Ontologically speaking, we cannot consider a certain worldview as an existing reality beyond the mental model that created it. (shrink)

Kahneman's theory of two systems assumes that human decision making in Economy is based on two cognitive systems, one that is automatic, intuitive and mostly unconscious, and one that is reflexive, rational and fully conscious. The authors consider Kahneman’s approach incomplete and limited in accounting for the creativity of embodied agents grasping the opportunities afforded by physical and social environments. This limitation leads us to argue for the existence of a third system in decision making in Economy, the creative intuition (...) based on direct perception of affordances, addressing not only the dispositions and goals of agents but also the social and environmental responsibility of corporations and governments. The authors argue that the third decision-making system the authors propose implies a concept of intuition that is different from the type of association process discussed by Morewedge and Kahneman [2] and gives an example of the third system operation, the Bolsa Família in Brazil, and finding new options for the funding of similar programs. This paper presents an argument against the A-Theory of time. Briefly, I shall contend that the A-Theorist has no explanation for why the present moment in particular has the metaphysical privilege she accords it, and that this puts the theory at a disadvantage. In what follows, I shall begin by presenting this argument. I will follow that with some potential explanations for why the present moment is privileged and reasons militating against them, in addition to some other possible objections to (...) my argument and my responses to them. The conclusion will be that the A-Theorist fails to provide either an obvious or a theoretical explanation of the present time’s privileged status and is thereby at a theoretical disadvantage to theories that do not posit a metaphysically privileged present time. A teoria dos dois sistemas (Kahneman, 2011), em suas várias vertentes, assume que a tomada de decisão humana é baseada em dois sistemas cognitivos: um que é automático, rápido, agindo com mínimo esforço cognitivo, intuitivo (no sentido de Morewedge & Kahneman, 2010), e majoritariamente inconsciente; e outro que é reflexivo, lento, atuando com intenso esforço cognitivo, racional e totalmente consciente. Neste trabalho, investigamos a teoria dos dois sistemas e sua aplicação na tomada de decisão econômica em governos democráticos, com ênfase (...) especial na proposta de Kahneman. Consideramos sua abordagem incompleta e limitada na explicação do processo intuitivo que orienta a tomada de decisão. Essa limitação nos leva a defender a existência de um terceiro sistema de tomada de decisão em Economia: a intuição ecológica criativa, baseada no attunement entre affective drives e percepção direta de affordances, abordando não só as disposições e objetivos dos agentes, mas também a responsabilidade socioambiental das empresas e governos. Argumentamos que o terceiro sistema de tomada de decisão que propomos implica um conceito de intuição diferente do associativismo de ideias de Simon (1992), e damos como exemplo do funcionamento do terceiro sistema o processo de tomada de decisão que conduziu à formação do Banco Finapop, no Brasil. On March 14-15, 2006, at the US National Institute of Standards and Technology (NIST) in Gaithersburg, MD there took place the first Upper Ontology Summit (UOS). This was a convening of custodians of several prominent upper ontologies, key technology participants, and interested other parties, with the purpose of finding a means to relate the different ontologies to each other. The result is reflected in a joint communiqué, directed to the larger ontology community and the general public, and expressing a joint (...) intent to build bridges among the existing upper ontologies in ways designed to increase and rationalize their utilization and to enhance their semantic interoperability. A Teoria dos Dois Sistemas, proposta por Kahneman (2011), pressupõe que a tomada de decisão no contexto econômico se baseia em dois sistemas, um que é automático, intuitivo e principalmente inconsciente e outro reflexivo, racional e totalmente consciente. Consideramos a abordagem kahnemaniana incompleta na medida em que a concepção dos sistemas 1 e 2 não é suficiente para explicar os processos de tomada de decisão. Neste artigo, nosso desafio é mostrar que, diferentemente dos sistemas de Kahneman, a tomada de decisão (...) está ancorada na percepção direta de affordances e é a base das escolhas conceituais, que envolvem experiências sensório-motoras advindas da reciprocidade entre agente e ambiente. Concluímos este artigo, argumentando que, diferentemente da concepção de sistema 1 kahnemaniano, na perspectiva ecológica, a tomada de decisão advém de experiências não conceituais, da percepção direta, não automática, sem envolver representações mentais e processamento de informações. Recent years have seen rapid progress in the development of ontologies as semantic models intended to capture and represent aspects of the real world. There is, however, great variation in the quality of ontologies. If ontologies are to become progressively better in the future, more rigorously developed, and more appropriately compared, then a systematic discipline of ontology evaluation must be created to ensure quality of content and methodology. Systematic methods for ontology evaluation will take into account representation of individual ontologies, (...) performance (in terms of accuracy, domain coverage and the efficiency and quality of automated reasoning using the ontologies) on tasks for which the ontology is designed and used, degree of alignment with other ontologies and their compatibility with automated reasoning. A sound and systematic approach to ontology evaluation is required to transform ontology engineering into a true scientific and engineering discipline. This chapter discusses issues and problems in ontology evaluation, describes some current strategies, and suggests some approaches that might be useful in the future. (shrink)

Com o uso massivo e a dependência das redes sociais, muitas pessoas descobriram fontes de ganhos fnanceiros a partir da exposição da imagem, seja da sua ou de outrem. Nesse cenário, a intimidade de centenas de crianças é exposta por seus pais ou responsáveis em troca de audiência, fama e recursos fnanceiros. Partindo dessa problemática, o presente artigo investiga os impactos do trabalho infantil mediante a exploração (...) da imagem e da intimidade da criança nas plataformas digitais. In this scenario, the intimacy of hundreds of children is exposed by their parents or guardians in exchange for audience, fame and fnancial gain. Based on this problem, this article investigates the impacts of child labor through the exploitation of the image and intimacy of the child on digital platforms. Destaca-se a importância da vítima no processo de perfilamento de criminosos, pois é com base na averiguação dos traços físicos e psicológicos deixados na pessoa que sofreu o delito que é possível traçar o perfil criminal do ofensor. Constata-se a estagnação do ensino do criminal profiling no Brasil.

Os autores estudam um caso de linchamento ocorrido na cidade de Guarujá. Formulam sua hipótese a partir da teoria mimética de René Girard, demonstrando, no caso concreto, a presença de sinais vitimários que tornam um indivíduo suscetível a ser tomado como bode expiatório de uma comunidade em crise. Problematizam sobre a questão da mentalidade persecutória, justiça comunitária e sistema judiciário.

The main aim of this article consists in an interpretation of the concept of Ereignis (Event) in the work of Martin Heidegger, explaining central aspects of the modification produced in the development of this work by the movement known as Kehre (turn-around), which implies the transition from the fundamental ontology or analytics of the finitude for the thought of the truth of Being.

RESUMO Versa o presente artigo sobre a regulação do linchamento no Direito Romano do período antigo, em especial sobre o artigo 9º da Tábua III das Leis das XII Tábuas. A partir de uma metodologia de análise qualitativa, revisão bibliográfica e interpretação textual, os autores objetivam ampliar a visão tradicional sobre o linchamento, compreendendo a institucionalização de sua prática no Direito Romano e sua função no contexto de formação da cultura jurídica do período antigo. A hipótese de trabalho é a (...) de que o artigo 9º da Tábua III das Leis das XII Tábuas apresenta, historicamente, uma forma de punição intermediária entre a linchamento popular extralegal e a pena criminal prevista em lei. Do ponto de vista jurídico-antropológico, a comprovação da hipótese permitiria concluir a ideia de que a pena praticada na antiguidade é uma evolução do controle social informal da violência. ABSTRACT The following paper is about the lynching regulation in Roman law in Ancient Era, especially in what comes about the article 9 of Table Three from Twelve Tables. Making use of a methodology based in qualitative analisys, literature review and interpretation, the auctor aim to expande the traditional view about lynching, understanding the institutionalization of their practice in Roman Law and it’s function in the legal culture in Ancient Era. The working hipothesis is that the article 9 of Table Three of Twelve Tables presents, in a historical context, a intermediate form of punishment between extralegal collective lynching and criminal penalty provided by law. From a legal-anthropological point of view, the proof of the hypothesis would allow us to conclude the idea that the penalty practiced in antiquity is an evolution of informal social control of violence. A tragédia de Orestes, escrita pelo tragediógrafo grego Ésquilo, influenciou decisivamente o pensamento ético-político de Hegel. Em seu ensaio sobre o Direito Natural (1802-1803), o filósofo alemão associa seu conceito de absoluto com sua interpretação da tragédia grega, ato com o qual expõe sua concepção da vida ética absoluta, dando continuidade à ideia que havia esboçado, no âmbito teológico, em "O Espírito do cristianismo e seu destino", i.e., a de que o destino e a justiça trágica forneceriam os termos de (...) uma alternativa aos conceitos jurídicos kantianos e cristãos de justiça. Mas, em "Sobre as maneiras de tratar cientificamente o direito natural", Hegel vai além. Ele demonstra que o gênero trágico apresenta uma concepção de ética e política que pode ser uma alternativa às concepções modernas do direito natural, o que permite a Hegel opor a representação trágica da unidade da vida ética absoluta ao dualismo e às dicotomias que estruturam as teorias políticas de seu tempo. Essa intuição da tragédia propiciou ao filósofo compreender a vida ética absoluta como o verdadeiro fundamento da ética e da política. Enquanto tal, ela pressupõe, necessariamente, todas as teorias do Direito Natural. Hegel denomina essa representação da unidade da vida ético-política como "a representação da tragédia da vida ética". A obra emblemática e talvez até mesmo inspiradora dessa compreensão do direito natural é "Eumênides", de Ésquilo, peça que encerra a trilogia "Oresteia". A partir dela, Hegel desenvolve, no capítulo intitulado “a ciência especulativa e o direito natural”, sua concepção trágica da vida ética absoluta. É que a tragédia de Orestes expõe o problema político que Hegel quer resolver: as relações entre o universal e o particular, o todo e as partes, o Estado e o indivíduo, etc. Além de explicitar o problema político, a obra de Ésquilo também expõe a solução do que Hegel considera ser o conflito absoluto, i.e., o jogo das oposições (universal/particular, todo/partes, Estado/indivíduos) que consiste na essência da vida ética e política. Tal solução se dá, na peça, com o julgamento do herói, Orestes, e a consequente pacificação das Erínias, transformadas em Eumênides. Esse movimento é a culminação da trilogia "Oresteia" e ilustra o tipo de reconciliação que Hegel procurava produzir com sua Filosofia do Direito: a (re)organização da totalidade ética. (shrink)

Em sua Filosofia do Direito, Hegel, ao tratar da instituição da família e de seu papel na educação dos filhos, intuiu um traço característico da subjetividade infantil: no coração das crianças haveria um desejo de pertencer ao mundo dos adultos. Trata-se de um desejo que poderíamos qualificar de mimético, no sentido da teoria de René Girard, já que as crianças adotam os pais como seus primeiros modelos. Na teoria hegeliana, esse elemento mimético adquire, junto à educação infantil, uma importante função (...) na formação da personalidade moral. A educação é uma exigência da própria criança, que possui de maneira inata o sentimento de não estar satisfeita em ser aquilo que é e o desejo de pertencer ao mundo adulto. Hegel, por isso, é um crítico da pedagogia que estagna as crianças na subjetividade infantil. Representando-as como perfeitas no estado de imperfeição em que se encontram, essa pedagogia perturba a espontânea carência do estado infantil, traço que impele naturalmente a criança ao autodesenvolvimento. O erro desse tipo de abordagem pedagógica está em não conceber o papel da mediação na formação da personalidade moral. Se o adulto, enquanto modelo, valoriza a criança em seu estado de infantilidade, é natural que ela adote essa mesma estima sobre si mesma, seguindo a opinião exterior. Logo, a valoração subjetiva, que deveria centrar-se no modelo ético, volta-se, pela mediação do modelo adulto, ao próprio Eu vazio da criança, que cresce concebendo- se como realidade autônoma, independente dos demais, gerando nela o desinteresse pelas relações substanciais do “mundo do espírito”. O narcisismo infantil seria, pois, uma decorrência da perda de referência ao modelo ético da vida adulta. Desse vazio “ontológico” da criança surge a necessidade de sua formação por meio do processo pedagógico. Os pais, que constituem o modelo imediato das crianças, não só devem estimular nelas a adoção do comportamento ético, como também punir as suas transgressões morais. A finalidade da punição não é a justiça enquanto tal. Trata-se, antes, de uma intimidação subjetiva e moral exercida contra a liberdade ainda encerrada na natureza, tendo como escopo elevar, na consciência e na vontade, a esfera da universalidade e da razão. Portanto, na educação dos filhos, o ético e o mimético são indissociáveis. Lendo Hegel a partir de René Girard, poder-se-ia usar o termo “mimeticidade” para designar essa unidade entre a imitação natural (subjetividade) e a promoção pedagógica e cultural de modelos comportamentais voltados ao Bem (moral objetiva). Pela adoção de modelos éticos, a criança tem a oportunidade de vivenciar a “eticidade” ainda sem oposição, como seu sentimento mais imediato, mais íntimo e “próprio”, vindo a adquirir, na vida adulta, a autonomia moral concreta de uma personalidade livre e racional, exercida em coerência com as demais.
